Ông Trần Hùng, cựu cục phó quản lý thị trường, bị VKS đề nghị 9-10 năm tù với cáo buộc nhận hối lộ 300 triệu đồng để bao che cho doanh nghiệp sản xuất sách giáo khoa giả.
Sáng 21/7, sau hai ngày xét xử, VKSND Hà Nội đưa ra quan điểm luận tội với ông Hùng và 33 bị cáo trong vụ án sản xuất 27.000 sách giáo khoa giả.
Theo VKS, vụ án là một điển hình cho sai phạm về sản xuất hàng giả. Các bị cáo, mỗi người ở một khâu khác nhau, đã giúp sức cho Cao Thị Minh Thuận (Giám đốc Công ty Phú Hưng Phát) sản xuất lượng lớn sách giáo khoa giả.
Để xảy ra sai phạm còn có trách nhiệm của cán bộ tuyến đầu phòng chống gian lận thương mại và trực tiếp là Đội quản lý thị trường số 17 cùng tổ công tác của Tổng cục Quản lý thị trường. Một số cán bộ quản lý thị trường, điển hình như Lê Việt Phương (Đội phó Quản lý thị trường 17) đã vì động cơ cá nhân mà vụ lợi để làm trái công vụ, ảnh hưởng đến hoạt động đúng đắn của cơ quan nhà nước.
Tại toà, 35/36 bị cáo đã thừa nhận hành vi phạm tội, xin giảm nhẹ hình phạt; duy nhất ông Trần Hùng không thừa nhận. “Nhưng căn cứ các lời khai, kết quả thực nghiệm, sơ đồ do người đưa tiền vẽ, và các chứng cứ thu thập được; đủ căn cứ xác định bị cáo Hùng đã nhận hối lộ 300 triệu đồng”, VKS nêu quan điểm, đề nghị HĐXX tuyên phạt 9-10 năm tù.
Đối với Nguyễn Duy Hải (lao động tự do, bị xác định Môi giới hối lộ), VKS đề nghị mức án 1 năm 11 tháng tù – bằng thời gian tạm giam, đồng thời đề nghị trả tự do cho bị cáo tại tòa.
Trong ba người ở Đội Quản lý thị trường 17 bị xét xử về tội Lợi dụng chức vụ quyền hạn trong khi thi hành công vụ, bị cáo Lê Việt Phương (cựu đội phó) bị đề nghị 30-36 tháng tù; Phạm Ngọc Hải 24-30 tháng tù treo và Thành Thị Đông Phương 18-24 tháng tù treo.
Ở nhóm bị cáo Sản xuất, buôn bán hàng giả, bà Cao Thị Minh Thuận bị đề nghị 11-12 năm tù; 31 người còn lại bị đề nghị 24-30 tháng tù treo đến 7-8 năm tù.
Trong hai ngày xét xử, ông Trần Hùng là người duy nhất không nhận tội. Bị cáo khai, ngay sau khi quản lý thị trường phát hiện 27.000 quyển sách giáo khoa giả tại Công ty Phú Hưng Phát, giám đốc Thuận đã liên hệ nhờ ông giúp đỡ. Còn Nguyễn Duy Hải, cộng tác viên thường xuyên, đã báo tin và sau đó cũng đặt vấn đề nhờ giúp đỡ cho bà Thuận. “Thế nhưng khi Hải mang túi đen đựng tiền lên đã bị tôi chửi ngay, đuổi ra khỏi phòng. Tôi không hề nhận 300 triệu đồng từ Hải”, ông Hùng khai tại toà.
Hải khai, khi cầm túi tiền lên phòng ông Hùng còn có hai người khác ở đây. Trình bày trước tòa với tư cách là nhân chứng, hai người này đều nói thấy Hải cầm túi màu đen lên phòng nhưng đã bị “ông Trần Hùng quát, yêu cầu mang đi”. Về việc ông Hùng “có nhận tiền hay không”, họ cho rằng không chứng kiến nên không biết.
Ngược lại, Hải khẳng định đã nhận tiền từ bà Thuận để đưa cho ông Hùng. Việc đưa nhận tiền chỉ có Hải và ông Hùng biết. Còn cáo trạng xác định, sau khi phát hiện 27.300 cuốn sách giáo khoa giả, bà Thuận với Nguyễn Duy Hải nhờ ông Hùng “tha” với điều kiện sẽ chi 400 triệu đồng. Sau cuộc trao đổi với Hải, ông Hùng “hướng dẫn thay đổi lời khai về nguồn gốc”, chuyển thành sách do người khác mang đến ký gửi.
Sáng 15/7/2020, Hải cầm 300 triệu đồng của Thuận đựng trong túi nylon màu đen đến phòng làm việc ông Hùng. Tại đây, Hải gọi điện thoại cho bà Thuận để nói chuyện trực tiếp với ông Hùng, nghe cụ thể hướng dẫn.
Do trong phòng có hai người khác, Hải cầm túi tiền ra về. Chiều hôm sau, bị cáo này cầm 300 triệu đồng quay lại phòng làm việc đưa cho ông Hùng.
Ngoài việc hướng dẫn bà Thuận thay đổi lời khai về nguồn gốc số sách, ông Hùng còn gọi điện thoại chỉ đạo đội phó Lê Việt Phương “tạo điều kiện giúp đỡ Thuận” theo hướng xử lý hành chính. Căn cứ kết quả thực nghiệm, nội dung dữ liệu trích xuất từ điện thoại đã “đủ cơ sở chứng minh ông Hùng đã nhận 300 triệu đồng” của bà Thuận, thông qua Hải, theo VKS.
Ngoài hành vi trên, bà Thuận còn nhiều lần đưa tiền cho Lê Việt Phương và Đội Quản lý thị trường 17 với tổng số tiền 330 triệu đồng sau khi sự việc ở Phú Hưng Phát chỉ bị xử phạt hành chính. Nhận số tiền này, Phương chia cho hai cấp dưới 11 triệu đồng, còn giữ lại cho cá nhân.
